Thank you for reviewing these Terms and Conditions of Use (the “Terms of Use,” “Terms,” or “Agreement”) provided by Potflare (“we,” “us,” or “our”). This Agreement sets out the conditions on which you (“you,” “your,” “User,” or “Users”) may access our website at https://potflare.com/ (the “Website” or “Site”) and its related services (the “Services”). It explains our responsibilities to you and the responsibilities you accept when using Potflare.
By browsing the Site or using its content, Services, or tools, you accept these Terms without qualification or limitation. These Terms constitute a binding agreement governing your use of the Site and Services, including provisions that continue after your use ends. If you do not agree with any part of these Terms, you must not use the Site.
Your access to the Website and use of the Services are permitted solely for personal entertainment. The Website and Services primarily provide gaming experiences and access to the features made available on the Website.
All game outcomes on the Site are produced by our provably fair system, and rewards are allocated according to those outcomes. You accept the system’s result as final. A mistake in the user interface does not give you a right to any item displayed on the Site.

Agreement to terms
By visiting the Website or participating in Potflare games or contests (each a “Contest”), you: (i) confirm that you have read these Terms and agree to comply with them and be legally bound by them; (ii) undertake to meet the obligations and follow the rules and scoring requirements of each Contest you enter; and (iii) represent that you have the legal capacity and authority to enter into this Agreement. Potflare may establish additional conditions and rules for individual Contests. Participation in a Contest constitutes acceptance of those additional provisions, which are incorporated into these Terms by reference. If you do not accept these Terms, you must not access or use Potflare, participate in its Contests, or use the Website’s other offerings.
Potflare may revise these Terms at any time without being required to give advance notice. We will update the “Date last modified” when revisions are made, and the revised Terms will take effect upon publication. For material changes, we will provide notice through a prominent announcement on the Website and/or a message to the email address we hold for you. Continuing to use Potflare after a revision constitutes acceptance of the revised Terms. If you disagree with a change, you must discontinue your use of Potflare. A breach of these Terms immediately ends your permission to use Potflare.
Age restrictions
You may not use Potflare if you are younger than eighteen (18) or have not reached the age of legal majority where you live, even with the permission of a parent or guardian. Access to Potflare requires a compatible web browser.
The Services are offered in the United States other than Nevada and Washington state. Access and participation are prohibited in those two states, and individuals from those states are not eligible to use the Services or receive prizes.
You are subject to the laws of the jurisdiction in which you reside and/or access Potflare. The Services are void wherever applicable law prohibits or restricts them. Potflare may require additional evidence or documentation to confirm your identity and compliance with eligibility requirements before allowing Contest entry or awarding a prize. If identity or eligibility is disputed, Potflare has the sole right to resolve the matter using any information it has obtained.
Potflare does not represent that you are legally entitled to use the Services or that its Contests are lawful or available in your jurisdiction. No person connected with Potflare is authorized to give such assurances. The Services are not directed at locations where their use is unlawful or restricted, and their availability does not amount to an offer or solicitation in those locations. You access the Services at your own risk, and Potflare accepts no liability where your participation is prohibited or limited by law. Creating an Account or entering a Contest from a jurisdiction that prohibits those activities violates both local law and these Terms and may result in the disabling or closure of your Account.
When you provide payment information for a Contest or deposit, you represent that you lawfully own the account associated with the payment method. Using a payment method that you do not legally own is a breach of these Terms.
Potflare may, at its discretion, refuse access to the Services to any person.
Account restrictions
Each person may maintain only one (1) Account. If Potflare determines that you have opened more than one Account, you agree that, in addition to any other available measures, Potflare may suspend or close your Accounts, refuse you future access to the Services, and withhold or recover prizes awarded to you.
You are responsible for protecting the confidentiality of your login information and passwords. Allowing another person to participate in Contests through your Account violates these Terms. Notify us immediately if you believe your Account has been used without authorization. We are not liable for loss or damage resulting from your failure to report unauthorized use. Any registration information we request must be accurate and complete, and you must keep it up to date.
Your Account is not transferable. You must never permit or assist another person, particularly anyone under eighteen (18), to use your Account in a way that breaches local or international laws or the standards of the jurisdiction in which either of you lives. You are fully responsible for misuse of Potflare through your Account and for activities performed by others using it. A breach may be reported to the appropriate authorities and will result in loss of the Account. Potflare is not responsible for losses caused by another person’s use of your Account, with or without your permission, unless you previously notified Potflare, as required, that your login credentials had been compromised. Without that prior notice, you remain responsible for the consequences of unauthorized access and misuse.
Funds
When you add funds to your account wallet on the Website (the “Wallet”), you acknowledge that the credits obtained (“Coins”) have no real monetary value and that virtual items acquired cannot be exchanged for real money. Virtual items are purchased only for use in games on the Website. Purchases of virtual items are non-refundable once the transaction is complete and the item has been delivered. If you have difficulty receiving or accessing a purchased product, contact support@potflare.com.
The Website is not a financial institution. Wallet funding is processed through a third-party payment service outside our control. Your relationship with that payment service is outside our responsibility, and we are not liable for problems involving its services.
Additional conditions may apply to purchases on the Website and are incorporated into these Terms by reference. You agree to observe those conditions, including any requirement to confirm that you meet the legal age for the relevant service or feature. If these Terms conflict with specific conditions applicable to a particular part of the Website or a service offered through it, those specific conditions govern your use of that part or service. Potflare may change the Website, the Services, and the prices of products or services at any time without advance notice.
Verified Potflare users may replenish their Wallet with a specified quantity of free credits. These credits are made available through the Rain bonus or by claiming the free daily case.
Redemption rules
Only prizes may be redeemed; deposited funds are not redeemable. All Coins must be fully wagered before any redemption, whether in prizes or cryptocurrency, can take place. Redemptions may be made only to the Account holder, never to a third party. Cryptocurrency redemptions arising from fiat deposits require completion of the Know Your Customer (“KYC”) process.
Games, Contests and features
Potflare provides Contests and other features through which users may win prizes. Contest participation is complimentary. We may change or remove available features and may modify or discontinue a Contest without advance notice. Each Contest may have different rules and scoring methods. Its official rules, including any updates, form part of these Terms by reference.
Before entering a Contest, you are responsible for reading its rules and keeping informed of revisions. By participating, you agree to comply with the current version of those rules. Failure to do so results in immediate disqualification and may lead to restriction or termination of your access to Potflare.
Contest winners are determined in accordance with the official documentation for the applicable Contest. Potflare must not be used for unauthorized gambling.
You may deposit funds on the Site to obtain credits that can be used to purchase cases. Free credits may also be obtained through the Rain bonus or by claiming the daily free case.
Case Battles let two to eight players compete individually or in teams by opening selected cases over one or more rounds. Tickets generated by the provably fair system determine the items opened. The selected battle rules determine the winner or winners and how the combined item value is allocated. Standard battles compare total item values, while Crazy, Terminal, Jackpot, and Shared formats apply the rules displayed for those modes.
In Upgrader, you select a wager and a higher-value target from the available virtual items. The wager, target value, and applicable game configuration determine the winning chance, and you choose the position of the winning range. The provably fair roll determines whether the upgrade succeeds. Successful upgrades credit the applicable prize value to your account under the game’s rules.
In Case Opening, you choose an available case and use the required credits to open it. The provably fair system generates a ticket, which selects an item according to the case’s published item ranges and odds. The selected item’s value is credited in accordance with the game’s rules.
Rain: The “Rain” rewards program allows each play on the Website to contribute to the Rain Pool. A Rain session lasts up to thirty (30) minutes, during which users meeting the requirements shown on the Site may claim an equal share of the accumulated pool. Rain is a bonus for active users and forms part of the complimentary gaming experience. Abuse of this feature may result in Account termination at the discretion of the Potflare team.
Results and rewards
We have sole discretion to determine Contest results and winners, and our decisions are final. We may revise results to correct calculation errors or discrepancies or to address breaches of these Terms. Potflare’s decisions about Contest winners are binding. Although we are not required to delay prize distribution while a correction is considered, we may recover prizes when a correction is necessary. By opening an Account and/or entering a Contest, you unconditionally accept Potflare as the sole adjudicator of disputes concerning Contest winners and agree to cooperate with any required recovery of prizes.
We may disqualify a participant from a Contest for any reason at our sole discretion. Potflare may also invalidate a Contest result to prevent abusive, illegal, or unfair conduct, or where it considers there to be a risk of such conduct.
Potflare may cancel Contests at its discretion without limitation. If Potflare considers your conduct improper, unfair, fraudulent, or damaging to the Services or other users, it may disqualify you from a Contest or the platform, withhold or recover prizes, or suspend, limit, or close your Account. Such conduct includes, without limitation: supplying false identity or payment information needed to use the Services or obtain a prize; violating conditions governing permitted payment methods; breaching these rules; obtaining points or prizes through unauthorized scripts or automated tools; disrupting Contest administration or related computer programs; accessing other users’ information without permission; spamming, abusing, or harassing others; exploiting the Services; or otherwise violating these Terms. Requiring you to return or forfeit a prize does not prevent Potflare from reporting the matter to law enforcement or pursuing legal remedies.
If the Services cannot operate as intended, Potflare may take corrective action at its sole discretion. This includes circumstances in which the Site is compromised, entries are not processed under the rules, or viruses, bugs, tampering, unauthorized intervention, participant actions, fraud, technical faults, or other causes affect the administration, security, fairness, integrity, or proper operation of the Services. Potflare may disqualify persons involved and/or cancel, end, extend, modify, or suspend the Services, selecting winners from eligible entries received before the disruption. Notice of a modification or suspension may be posted on the Website.
A failure by Potflare to enforce a provision of these Terms because of events beyond its control will not constitute a breach of this Agreement. Such events include natural disasters, war, fire, riots, earthquakes, terrorism, acts of public enemies, government action outside Potflare’s control (other than compliance with applicable codes and regulations), and other major unforeseen events.
Contest prize terms
Contest prizes may take different forms. Consult the official rules of the relevant Contest for full details of the prizes and any restrictions.
Prize substitutions and transfers are not permitted unless Potflare allows them at its discretion. All prizes are supplied “AS IS,” without express or implied guarantees or warranties from Potflare, including any implied warranty of merchantability or fitness for a particular purpose. If a legal authority challenges a prize award or your receipt of it, we may withdraw, cancel, suspend, modify, or otherwise revise its distribution.
Winnings credited to your Account by mistake remain our property and will be removed when the error is identified. If you redeem such winnings before the error is discovered, the amount redeemed becomes a debt owed by you to us.
A prize award depends on the Contest actually taking place. We may cancel a Contest at any time for any reason. If a Contest is canceled, entry fees will be returned to all participants unless these Terms expressly provide otherwise.
Individual Contests and promotions have their own official rules. You should read the rules for each Contest or promotion before taking part.
To receive a prize, you may be asked by email to sign and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release (together, the “Affidavit”), together with required tax documents, within seven (7) days after notification. By entering a Contest, you agree to receive, complete, and return the Affidavit and/or tax documents by email or U.S. Mail, as applicable. Failure to return the documents on time, failure to claim a prize or prize notice, the return of either as undeliverable, or non-compliance with these Terms will result in forfeiture. We may then award the prize to an alternate winner at our sole discretion. You are responsible for all taxes applicable to prizes you receive or use.
Code of conduct
Potflare seeks to provide a safe and respectful community. All members are expected to follow these Community Guidelines:
Lawful use: You must not use Potflare or any of its Services for an unlawful purpose or in breach of this Agreement.
Prohibited activities: Members must not engage in any of the following:
- Organizing or participating in unlawful conduct.
- Posting or helping others distribute content that is unlawful, infringing, slanderous, defamatory, offensive, obscene, or pornographic, or that violates the rights of Potflare, its users, or any third party.
- Threatening, harassing, or bullying other users.
- Using automated tools, including bots or scrapers, for activities on Potflare or its associated services.
- Abusing the reporting system or making false or misleading reports.
- Misrepresenting their identity or impersonating another person.
- Creating more than one (1) Account for the same person.
- Selling or transferring their Account to someone else.
- Disrupting Contest administration or attempting to interfere with Contest software, security measures, or related systems.
- Systematically exploiting rewards contrary to their intended purpose, including collecting free rewards by unauthorized means. These examples do not limit the conduct that may constitute misuse.
- Using Potflare abusively, outside its intended purpose, contrary to its policies or guidelines, or in violation of applicable law.
Consequences: A breach of these guidelines may result in Account suspension or termination and, where considered necessary, legal action.

No warranties
The Potflare Website is provided “as is,” without any express or implied guarantee or warranty. Potflare makes no representation or warranty about the accuracy, reliability, availability, or completeness of its content. In particular, we do not warrant that the Website will always be accessible or that its content will be complete, correct, or free of mistakes. Nothing on the Website constitutes professional advice. For legal, financial, or health advice, consult an appropriately qualified professional.
Termination
We may immediately suspend or end your access to the Services, without advance notice or liability, for any reason, including a breach of these Terms.
Provisions that are intended to continue after termination will remain effective. These include, without limitation, ownership provisions, warranty disclaimers, indemnities, and liability limitations.
We may also immediately suspend or terminate your Account for any reason, without prior warning or liability, particularly if you fail to comply with these Terms.
Your right to use Potflare ends immediately upon termination of access. Potflare may also suspend or close Accounts inactive for one hundred eighty (180) days or longer. Closure or cancellation removes access to the Account and its content and may result in loss of the username. Where we suspend or terminate an Account for breach of these Terms, we may retain funds to cover the costs of administering and enforcing these Terms. You must comply with restrictions or limitations imposed as part of a suspension or termination. To request closure of your Account, contact support@potflare.com.
DMCA and other intellectual property rights
Monitoring and copyright infringement claims
Potflare may, but is not obliged to, monitor, edit, disclose, decline to publish, or remove content from any part of the Website at any time and for any reason, at its sole discretion. We do not comprehensively review all content submitted to the Website. After receiving a complaint alleging that submitted content breaches these Terms, we may investigate and decide whether to remove it. We have no obligation to remove content and assume no liability for content or conduct by you or third parties on or outside the Website, including errors, defamation, libel, slander, omissions, false statements, obscenity, pornography, profanity, danger, or inaccuracies.
In appropriate circumstances, and at our sole discretion, we may end access for users who infringe another person’s copyright or otherwise violate these Terms.
If you believe your copyrighted work has been copied on the Website in a way that infringes your rights, you may notify us by supplying the following information under the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.C. § 512:
- A physical or electronic signature from a person authorized to act for the copyright owner.

Content on Potflare, including technology, software, accounts, names, logos, designs, music, and virtual items, is owned by or licensed to Potflare. It is protected by copyright, trade dress, patent and trademark law, international treaties, and other laws protecting intellectual property and proprietary rights. Potflare claims no ownership of intellectual property belonging to third parties.
Unless this Agreement expressly permits it, you must not copy, distribute, modify, create derivative works from, publicly display, perform, republish, download, store, or transmit materials supplied by Potflare. You must also not:
- Modify materials obtained from Potflare.
- Reproduce or electronically duplicate Potflare content, in whole or in part.
- Distribute copyrighted or proprietary material on Potflare without the permission of its rightful owner.
- Remove or change copyright, trademark, or other proprietary notices on materials obtained from Potflare.
- Use any part of Potflare or its materials commercially without authorization.
Printing, copying, altering, downloading, or giving others access to Potflare content contrary to this Agreement may lead to Account closure, exclusion from Potflare, and/or legal action. Intellectual property owners may pursue civil or criminal proceedings for unauthorized use of their work. You agree to defend and hold Potflare harmless from unlawful or unauthorized acts committed by you or through your Account.
Trademarks
Potflare owns, and may register, trademarks associated with its products and Services, including related graphics, logos, and service marks. You may not use them without Potflare’s express prior written permission.
Third-party links
The Services may contain links to third-party websites or services that Potflare neither owns nor operates.
Potflare does not control and is not responsible for the content, privacy policies, or practices of third-party websites or services. You agree that Potflare is not directly or indirectly liable for damage or loss alleged to arise from using or relying on content, goods, or services available from those third parties.
We recommend reading the terms and privacy policies of every third-party website or service you visit.
Returns and refunds policy
We do not issue refunds after an order has been completed and its digital product delivered. If you experience a problem receiving or downloading a product, contact support@potflare.com for assistance.
Errors and glitches
Encountering or exploiting a user-interface error does not establish a right to a particular item. Our provably fair system determines outcomes and the corresponding awards. You accept that the system’s final result is controlling and that a display or interface error does not entitle you to an item.
Governing law and disputes
The formation, validity, performance, and interpretation of these Terms will be governed by, construed, and enforced under the laws of XXXXXX.
Limited license
We grant each User a limited, non-exclusive, non-transferable personal license to access and use Potflare for private, non-commercial purposes on a single computer or mobile device. We also grant a limited, non-exclusive, non-transferable personal license to access Potflare’s paid features and upgrades, subject to any additional restrictions applicable to those purchases. That license likewise permits only private, non-commercial use on one computer or mobile device. Neither license transfers ownership. Except for the rights expressly granted by this Agreement, Potflare and its licensors and service providers retain all ownership, rights, and interests in Potflare and its copyrights, trademarks, and other intellectual property.
You must not copy or distribute Potflare materials and must prevent unauthorized access, use, or copying by others. You agree not to:
- Copy Potflare except to the extent allowed by this license.
- Modify, translate, adapt, or create derivative works or improvements from Potflare, whether or not those works could be patented.
- Reverse engineer, disassemble, decompile, decode, or otherwise attempt to obtain the source code of Potflare or any part of it.
- Remove, hide, obscure, or alter trademarks or copyright, patent, or other intellectual property or proprietary notices in Potflare or its copies.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make Potflare or its functionality available to third parties, including making it available on a network for simultaneous access by more than one device.
- Disable, bypass, or develop or implement a workaround for copy protection, rights-management, or security measures protecting Potflare.
- Use Potflare in breach of applicable laws or regulations, including for illegal gambling.
Marketing
Potflare appreciates its Users’ support and seeks to explain how certain information may be used for marketing and promotion. The following provisions apply:
Use of User information: By using Potflare, you agree that information including your username, profile image, city, and state may be used in Potflare advertising and promotional materials, unless prohibited by law.
Public sharing: You consent to public disclosure of your information during or after gameplay for the purpose of promoting Potflare.
Comments and feedback: Comments and feedback you provide to Potflare become the property of the Company. To the extent permitted by law, Potflare may freely use, sell, exploit, and disclose those ideas without restriction or payment to you.
Limitations of liability
The following limitations apply to your use of Potflare. Please review them carefully:
Voluntary use and risk: Your use of Potflare is a matter of your own choice and is undertaken entirely at your own risk.
“As is” and “as available”: Potflare is provided on an “as is” and “as available” basis, with no assurance that its use will produce a particular result.
Availability and security: Potflare does not guarantee continuous, uninterrupted, or secure access to the Services or any part of them.
Indirect losses: Potflare and its affiliates are not liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, data, or other intangible losses, even if advised that such losses might occur.
Liability cap: For any claim or cause of action, Potflare’s total liability to you is limited to the amount, if any, you paid Potflare for access to the platform during your registration, excluding charges for services and/or products supplied before the incident giving rise to the claim.
Account protection: Potflare is not responsible for lost funds, compromised Accounts, or unintended redemptions. You are responsible for securing your Account and taking appropriate protective measures.
System and service maintenance
Potflare may perform maintenance to protect the platform’s integrity and security. During maintenance, individual features or the entire platform may be unavailable. We aim to give advance notice, but updates may take place with or without notice. Potflare may also modify or discontinue any part of the Services, including Website availability, features, content, and Contests, at any time. We may limit features or Services or restrict access to some or all of the platform, with or without notice and without liability to you or third parties. Report problems with Potflare, including Account-related issues, to support@potflare.com.
Disputes
If a dispute arises between you and XXXXXXX, both parties will make good-faith efforts to resolve it amicably within a reasonable time. If no mutually acceptable resolution is reached within a reasonable period of at least thirty (30) days after that process begins, either party may bring the matter before the competent courts in XXXXXX, which will have exclusive jurisdiction over the dispute.
Alternative binding arbitration and class action waiver
Dispute resolution, arbitration and governing law
The party raising a dispute between you and Potflare must give the other party written notice. Notice to you is properly delivered when sent to the email address registered with Potflare. Notices to Potflare must be sent to support@potflare.com.
After notice is received, both parties will try to settle the dispute through amicable discussions. If it remains unresolved thirty (30) days after notice, the dispute will be referred to arbitration as described below.
If the parties cannot reach an amicable resolution, you agree that disputes will be resolved through arbitration. Potflare nevertheless retains the right to seek injunctive or equitable relief in the state and federal courts of XXXXXX or any other court having jurisdiction over the parties. Seeking that relief does not waive Potflare’s right to claim monetary damages.
For any dispute concerning these Terms or Potflare, you expressly waive: (i) the right to a jury trial; and (ii) the right to participate as a member of a class of claimants in a lawsuit, including a class action concerning the dispute.
Arbitration takes place without a judge or jury, and opportunities for review are limited. Subject to limited exceptions, the arbitrator’s decision is final and binding and may be entered in a court with jurisdiction. Except as otherwise provided, any claim, suit, action, or proceeding relating to Potflare or these Terms must be resolved exclusively by binding arbitration before one arbitrator under the Arbitration Rules and Procedures of JAMS Inc. (“JAMS”) or its successor. If JAMS cannot or will not set a hearing date within fourteen (14) days after a Demand for Arbitration is filed, either party may elect administration by the American Arbitration Association (“AAA”) or another arbitration provider agreed by both parties. Any necessary in-person hearing will take place in XXXXXX. The federal or state law of XXXXXX applicable to these Terms will also apply in arbitration. Proceedings must be individual and must not be consolidated with claims brought by other parties, including class proceedings. If a court or arbitrator finds that restriction unconscionable or unenforceable, the arbitration agreement will not apply, and the dispute must be brought before a competent court in New York County, New York. Potflare will pay the administrative and arbitrator fees for the arbitration, but not a participant’s travel or other attendance costs. Either party may nevertheless bring a qualifying claim in small claims court.
The Federal Arbitration Act governs the interpretation, enforcement, and conduct of arbitration, and an award may be entered as a judgment in any court with jurisdiction. All participants agree to comply with these Terms. Each party consents to service of process by mail or another method permitted by New York State law. You waive claims for attorneys’ fees and for indirect, special, punitive, incidental, or consequential damages, regardless of whether they were foreseeable or arose through negligence or another cause. Potflare is not liable for direct, special, incidental, exemplary, punitive, or consequential damages, including loss of use, data, business, or profits, arising from use of or inability to use Potflare, whether the claim arises in contract, warranty, tort (including negligence), strict liability, or otherwise, even if Potflare was advised that such damages were possible. Some jurisdictions do not allow limitations or exclusions for incidental or consequential damages; in those jurisdictions, the relevant limitations or exclusions above may not apply to you.
Steam and Valve affiliation
Potflare provides the following clarification regarding Steam and other trademarks belonging to Valve Corporation.
Independence: Potflare is not affiliated with, endorsed by, or associated with Steam or any trademarks owned by Valve Corporation.
Potflare operates as an independent online gaming platform, separate from Steam and Valve Corporation. Although some gaming services may relate to Valve Corporation games, Potflare is a distinct platform and is not part of Steam. We seek to make that distinction clear in our dealings with Users.
General terms
Relationship between the parties and third-party beneficiaries
Neither this Agreement nor your use of Potflare creates a joint venture, partnership, employment, or agency relationship between you and Potflare. You must not describe yourself as a Potflare representative or affiliate, and Potflare is not responsible for your statements, acts, or omissions. Except where expressly stated, this Agreement gives no rights to third-party beneficiaries.
Assignment of rights
Potflare may assign or transfer any or all of its rights and obligations under this Agreement and/or the Privacy Policy to another party at any time, with or without your consent. The transfer may release Potflare from further obligations under those documents. You may not assign or transfer your rights or obligations under this Agreement or the Privacy Policy without Potflare’s express prior consent. Any unauthorized assignment or transfer by you is void.
Circumvention and indemnification
You must not evade or attempt to evade these Terms or interfere with Potflare’s operations (a “Circumvention Act”). If Potflare determines, in its sole discretion, that you have committed a Circumvention Act or fraud involving Potflare, it may take legal action and report you to the appropriate authorities.
You also agree to defend and hold Potflare and its providers harmless from claims, losses, damage, and liabilities, including legal fees, resulting from your misuse of Potflare, breach of this Agreement, or failure to perform an undertaking in it. Potflare may assume exclusive control of the defense of a claim subject to your indemnity at your expense, and you must assist that defense. Potflare will seek to notify you of such proceedings when it becomes aware of them. This indemnification obligation continues after your Account or use of Potflare ends.
Events beyond our control
Potflare is not liable for delay or failure to perform caused by circumstances beyond its reasonable control. Examples include natural disasters, war, terrorism, government orders, fire, flood, accidents, network outages, strikes, and shortages of transport, fuel, energy, labor, or materials.
Waiver and severability
Potflare’s failure to exercise a right or enforce an obligation under this Agreement does not waive that right or obligation, which remains effective. If a provision is held invalid or unenforceable, it will be amended or removed only as necessary to comply with the law while seeking to preserve the parties’ original intent, or severed from the Agreement. The remaining provisions will continue in effect.
State-specific terms
California residents have certain consumer rights under California Civil Code Section 1789.3. Entire agreement
These Terms constitute the complete agreement between you and Potflare on their subject matter and replace all prior oral or written discussions and agreements. A change to these Terms or the Potflare Privacy Policy is valid only if it is recorded in writing and signed by Potflare.
Additional rules
Potflare may adopt further policies for particular services, including Contests, tournaments, or promotions. Participation in those services requires compliance with their specific policies as well as these Terms.
